AGREEMENT
Yaldi Company provides a car rental service within the Emirate of Dubai in the United Arab Emirates. Yaldi enables its customers to drive vehicles 24 hours a day, 7 days a week. Yaldi provides you with comfortable transportation anywhere whether you are going to a meeting, or out for a late night out with friends, or shopping, as this service is available only to persons who have been approved and registered as customers of Yaldi.
This agreement defines the relationship, rights and obligations between the company and the customer regarding the use of Yaldi cars. This agreement does not in itself grant any right to use the cars. The customer shall agree and abide by all terms and conditions of trips when using the car in addition to the terms and conditions of this agreement.
Customer Statement
The customer acknowledges that he has received all explanations regarding the content and interpretation of this agreement, and that he has carefully reviewed and understood all of his obligations mentioned in it. The customer also declares that this agreement contains terms related to damages, liability and compensation, and that he is aware that this agreement may affect his rights and responsibilities in the event of any damage to the car or third parties. The Customer, whether a Yaldi Member or a Vehicle User, agrees to the following:
1 . Definitions, Schedules and Amendments to Terms
1.1 Definitions
Except as expressly set forth in this Agreement or unless the context otherwise requires:
- Account Page: means the Customer’s personal account section of the Yaldi App.
- Agreement: means the entire Agreement as amended or supplemented in writing from time to time.
- Form: means the Customer’s application form for Yaldi Membership.
- Driver’s License: means the license that authorizes the holder to drive a vehicle in the jurisdiction in which any Yaldi Vehicle is used.
- Eligibility: means a person who meets the legal eligibility requirements.
- Fees: means all fees and charges specified under this Agreement in accordance with the Fee Schedule.
- Business Area: means the area designated by Yaldi as the Business Area for the start and end of a Trip.
- Bills: means all fees and other amounts for which the Customer is responsible and which relate to the use of a Vehicle, or other amounts due under this Agreement, which are calculated on a regular basis, and which may be available in the App.
- Customer: means the party authorized by Yaldi through the registration process.
- Membership Access: means the electronic access available to the Customer, which enables him to use the Vehicle via the Yaldi application on Android or iOS using the username and password.
- Parking Rules: means the parking rules according to the Traffic Police Department in the United Arab Emirates, which determines where the Vehicle is parked within the area.
- Vehicle Fleet: means the fleet of vehicles as stated in the Mobile Application, within the commercial area of that operating city, regardless of the vehicle plate number.
- Yaldi Vehicle: means any motor vehicle registered with Yaldi, used for Yaldi’s car rental business under the concept described in this Agreement, and subject to the terms and conditions specified on the Yaldi Website, including all other devices or property installed or affixed thereto.
- Website: is www.yaldi.ae and such other locations as Yaldi may specify from time to time.
- Trip Period: means the period of time between activation of the Vehicle and deactivation of the Vehicle (closing the Yaldi Vehicle in the manner granted by the Company to the Customer).
- Vehicle activation: means accessing or opening the Yaldi vehicle through the method given by the company to the customer.
- Vehicle deactivation: means closing the Yaldi vehicle through the method given by the company to the customer.
- Fine: means additional fees imposed on the customer due to non-compliance with Yaldi terms and conditions.
1.2 Schedules
The following schedules (Schedules) are incorporated into this Agreement and published on Yaldi’s website, and these schedules are considered an integral part of this Agreement:
- Fees and Fines for Yaldi Services (Schedule No. 1)
- Salik Fees (Schedule No. 2)
1.3 Amendment of Terms
The current version of this Agreement is available on the Yaldi website and mobile application. Yaldi reserves the right to amend, supplement or replace this Agreement from time to time. The Customer acknowledges and agrees that all amendments to this Agreement are valid and binding on the Customer as a condition for the continuation of his rights, including the use of vehicles by reserving a Yaldi vehicle or using a Yaldi vehicle. The Customer acknowledges and agrees that Yaldi may amend these Terms from time to time.
2 . Interpretation and General Conditions
2.1 Interpretation
Unless the Agreement otherwise provides, or the context otherwise requires:
- The subdivisions of this Agreement are referred to, in sequential order, as “sections”, “subsections”, “paragraphs”, “subparagraphs”, “clauses” and “subclauses”.
- The words “herein”, “below” and other words of similar significance to this Agreement are intended to refer to the whole and not to any particular provision of this Agreement.
- The headings included in this Agreement are for convenience only and are not intended to construe, define or limit the scope, extent or intent of this Agreement or any provision of it.
- The words “including”, “specifically”, “particularly” or words of similar significance following any general expression, term or matter shall not be construed as limiting such general expression, term or matter. If non-restrictive language (such as “without limitation” or other words of similar expression) is used to refer to it, it shall refer to all other items or matters that can reasonably be included within the broadest possible scope of such general expression, term or matter.
- Any reference to a law includes amendments thereto and regulations made thereunder, and any law or regulation supplementing, repealing or replacing it, and words referring to one gender include all other genders, and words in the singular include the plural, and words referring to individuals include corporations and corporations, and vice versa in each case.
2.2 Severability
In the event that any term, condition or provision of this Agreement is held to be invalid, prohibited or unenforceable, such term, condition or provision shall be severable from the remaining terms and conditions without invalidating the applicable terms and conditions of this Agreement.
2.3 Application of Remedies
Any remedy due to either party under any provision of this Agreement and as a result of the default of another party shall be in addition to, and not in lieu of, any other legal, common or equitable remedy that may also be available, and all such remedies shall apply either consecutively or concurrently.
2.4 No Waiver
The granting of any time or other leniency to any party to this Agreement, or the failure of any party to insist upon strict performance of any covenant, provision or condition of this Agreement, or to enforce its rights, shall not be construed as a waiver of the rights or remedies hereunder. Such rights shall remain in full force and effect.
2.5 Other Assurances
The Customer shall promptly deliver the documents and warranties to Yaldi, and shall take such further actions as Yaldi may reasonably request from time to time, in order to more effectively implement the purpose and intent of this Agreement, and to protect the rights and remedies created or intended to be created by this Agreement. The Company will likely send the Customer a shortened car rental agreement which he shall carry during the trip, and present it upon request of a law enforcement official. If a copy is not provided, the Customer may use this agreement.
2.6 Notices
Yaldi shall notify the Customer of the terms of this Agreement by the following means:
- The Company shall notify the Customer by posting on Yaldi’s website yaldi.ae .
- Any other notice or communication required or permitted by the Customer to Yaldi under the terms of this Agreement shall be sufficient if made by any of the following means:
- The noticed or communication shall be deemed to been delivered and received correctly and on time if it was sent in the normal course of transmission and was delivered and received at the address to which in was sent via email Support@Yaldi.ae .
If the notice or communication is properly and timely delivered and received, it shall be deemed to have been in the ordinary course of transmission and delivered and received at the address to which it was sent.
2.7 Entire Agreement
This Agreement and the Form constitute the entire agreement between the parties and there are no statements, representations, warranties, undertakings or agreements, written or oral, express or implied, between the parties except as set forth in this Agreement.
2.8 Binding Agreement
The terms of this Agreement shall be contractual and binding.
2.9 Applicability of the Agreement
This Agreement and everything contained herein shall be inure to the benefit of the parties hereto and shall be binding between them and their respective personal representatives, successors and assigns.
2.10 Joint and several Joint
Representations, warranties, undertakings or obligations shall be made by each person jointly and severally where there is more than one person.
2.11 Assignment
This Agreement shall be a personal agreement relating to the Customer and the Customer shall not be entitled to assign it, or assign its rights or obligations under it.
2.12 Currency
All amounts contained in this Agreement shall be in UAE Dirhams unless otherwise stated.
- Terms of Use and Additional Criteria
3.1 Terms of Use:
- The customer shall be at least 21 years old upon account activation.
- The customer shall be physically fit and qualified to drive the vehicle.
- The customer shall hold a driving license for more than one year in the UAE or outside the UAE, and this license shall be recognized according to the competent authorities.
- For tourism, Yaldi accepts the following driving licenses recognized by the authorities. Contact Yaldi Support for registration:
United Arab Emirates, Austria, Belgium, Spain, Germany, France, Ireland, Netherlands, Italy, United Kingdom, Turkey, Greece, Switzerland, Norway, Denmark, Sweden, Romania, Poland, Cyprus, Finland, Portugal, Canada, United States of America, Kuwait, Saudi Arabia, Bahrain, Qatar, Oman, South Korea, New Zealand, Hong Kong, Japan, Australia, Singapore, South Africa.
- The customer agrees to cooperate in providing general information necessary to confirm his eligibility. Yaldi shall reserve the right to request additional information at any time. It also reserves the right to reject the customer at its sole discretion.
3.2 Additional Criteria
Customer acknowledges that Yaldi may add additional requirements to the Terms of Use at any time. Such new requirements may disqualify Customer.
3.3 Continuing Requirements
Yaldi may from time to time verify Customers’ driving records and reserves the right to suspend or terminate this Agreement at its sole discretion. Yaldi may at any time require Customers to demonstrate compliance with local laws and impose additional policies.
3.4 Disqualification
Customer shall be disqualified for the following reasons, including:
- Suspension, revocation or expiration of a driver’s license
- Any black points or other incidents on Customer’s driving record
- If Customer is convicted or served with a notice of driving under the influence of alcohol or drugs
- Dangerous or reckless driving or exceeding the speed limit
Customer agrees to notify Yaldi of such suspension, revocation, changes, conviction or recall immediately. Failure to notify Yaldi of any of these events may result in Customer not being covered by Yaldi’s insurance policy when driving a Yaldi vehicle or in the termination of this Agreement. The Customer shall not drive or use a vehicle where he/she does not comply with the laws of the United Arab Emirates or any legal rules and regulations or any of the User Terms and Conditions.
- Subscriptions
4.1 Getting Started
The Customer needs to create an account in the Yaldi App to benefit from our services.
The Customer acknowledges that he/she has all the requirements set out in this Agreement and that he/she fully complies with them once I use the Vehicle upon creating an account with Yaldi. I acknowledge and agree that any traffic violations or black points incurred during the period from the moment the Vehicle is opened until the end of the rental period (either upon returning the Vehicle to Yaldi or upon the end of the trip as recorded in the App) will be my personal responsibility. I agree to transfer all such violations and black points to my account without the need for further consultation or approval from me.
4.2 Communications
Yaldi shall reserve the right to contact its Customer for any reason through any means of communication. The Customer shall bear the costs of contacting Yaldi customers through a landline
The contact details provided by the Customer upon registration with Yaldi shall be considered a legal means of communication. All communications, legal notices and information shall be provided to him/her through them.
The Customer shall ensure that these means of communication are working properly and shall be held responsible in the event of a failure of communication.
4.3 Termination of the Agreement
4.3.1 Termination by the Customer
The Customer may terminate this Agreement at any time by:
- Sending written notice by email or by any other agreed means
- Paying all due fees, fines, invoices or any other charges
- Returning all Yaldi property in his possession
4.3.2 Termination by the Company
Yaldi may terminate this Agreement or suspend the Customer’s use of Yaldi vehicles at any time, in the following cases:
- If the Customer fails to pay the fees due
- If the Customer fails to comply with and abide by this Agreement, including the Terms of Use
- In the event that the Customer loses his legal capacity
- In the event that the Yaldi vehicle is returned to a location other than the location permitted under the Parking Rules and Business Zone Rules
- Failure to notify the Company of any defect in the vehicle that adversely affects its operation or the safety of that vehicle
- In the event that the Customer makes a false statement or declaration, or conceals facts or circumstances required to be disclosed under this Agreement
Notwithstanding the foregoing, the Company shall have the right
4.3.3 Suspension of Use
The Company has the right to prohibit the continued use of the Yaldi Vehicle and notify the relevant authorities if it believes that there is a violation of the terms of this Agreement, including the Terms of Use or misuse of the Vehicle. This action includes the Customer’s exploitation of the use of Yaldi Vehicles.
4.4 Return of Property
The Customer shall immediately return the Vehicle to the Company, along with any other property belonging to it that may be in its possession or control, in accordance with its instructions upon termination of this Agreement or suspension of the Customer’s use of Yaldi Vehicles, for any reason. The Customer shall pay any legal fees, fines, costs, expenses or any other fees associated with enforcing any provision of this Agreement, including any costs related to the recovery of any of the above-mentioned property, or any amounts due.
- Ownership and Parking Rules of Yaldi Vehicle
5.1 Ownership
This Agreement does not contain any provision that transfers ownership or any right, title or interest to the Customer, including Yaldi Vehicles. The Customer agrees not to damage, modify, copy, tamper with or access the Membership in an illegal manner or any activation method of the vehicle installed in the Yaldi vehicle or any other property belonging to it.
5.2 Parking Rules
The Customer shall park the vehicle only in designated parking areas, where parking is legally permitted or in the parking spaces designated by Yaldi.
Any other fees that apply up to the time the vehicle is discovered and removed by the driving team, at the discretion and availability of Yaldi, are the responsibility of the Customer and shall be paid in full, including but not limited to: –
- The Customer shall bear the fines and fees paid by Yaldi to any authorities or third parties that shall be paid to Yaldi, regardless of whether they have been paid or are due to Yaldi. Appeals or objections shall be submitted after payment.
- Yaldi may impose additional fees in the event that the Company transfers the vehicle or bears any other item.
- Failure to comply will result in the imposition of other fees and penalties in accordance with the Driving Fees/Fines Schedule.
- Parking in multi-level car parks, as well as parking in malls, basements and closed complexes is prohibited.
- Booking a Yaldi Vehicle
6.1 Booking a Vehicle
- The Customer can book a Yaldi Vehicle through the mobile application, or other authorized mobile applications, or as specified by Yaldi from time to time.
- No booking fees will be charged. This booking will remain valid for a maximum of 30 minutes to reach the vehicle and start the journey.
6.2 Checking for damages before activating the Yaldi vehicle
The customer shall inspect the vehicle from the inside and outside for any defects, damages or excessive contamination. The customer shall immediately notify Yaldi of any defects, damages or problems noticed in the vehicle itself or any installed technology.
The customer must, if any defects, damages or excessive contamination are discovered before or after the trip, report them, either through the application or by calling customer service at the following number, or by email at support@yaldi.ae, and accurately and truthfully inform customer service of the nature of the discovered defects, damages or excessive contamination, and shall prove this through a video or photo only, by sending it via email, chats or the mobile application.
The customer may be prevented from using the Yaldi vehicle at its sole discretion for the following reasons:
- If the customer did not report damages, malfunctions or other problems before using our services.
- The customer is responsible for repairs, cleaning or other costs related to the Yaldi vehicle.
6.3 In the event that Yaldi vehicles are not fit for driving, a different vehicle will be allocated to the customer within a reasonable time and distance at the Company’s discretion, subject to availability and vehicle type if the customer’s reported comments result in the Yaldi vehicle being deemed unfit for use.
6.4 Vehicle Cleanliness
Customers are responsible for returning the vehicle in a clean condition and shall remove all personal items from the vehicle. Yaldi makes no representations or warranties regarding the cleanliness of any of its vehicles. The customer agrees to use the Yaldi vehicle on an “as is and where is” basis.
6.5 Vehicle Activation
Yaldi may allow the vehicle to be activated and the journey to commence, through an approved mobile application or through any other method that the Company may determine from time to time. Upon activation, the vehicle will be automatically unlocked for the customer’s use (Vehicle Activation).
6.6 Imposition of Fees
A fee will be charged to the customer for the use of the Yaldi vehicle once the vehicle is activated, with the customer being obligated to pay the Salik tariff and fees specified by the official authorities and shown in Schedules No. 2 in addition to 1.5 dirhams to the Company for each Salik gate crossing ticket. The fee is due in this case even if the vehicle is driven by someone other than the customer and the fee also applies if the vehicle is not driven or used.
6.7 Area of Operation
- The customer is entitled to use the Yaldi vehicle within the UAE, but the vehicle is only returned in the same business area from which the trip began, unless Yaldi agrees to return it elsewhere.
- The customer is personally responsible for the costs associated with returning the vehicle to the area, including, but not limited to, costs associated with vehicle repairs, car accidents or collisions, fuel, parking fees and towing services if the customer travels outside the business area.
- The customer is responsible for the vehicle and bears the fees until the vehicle is returned to the designated approved parking area.
- Termination of the trip
7.1 Obligations
It is related to termination of the trip When the customer wishes to terminate the trip, the customer is obligated to:
- The customer shall park the vehicle in accordance with the parking rules and in the permitted or specified parking spaces in the mobile application.
- The customer shall ensure that the key is returned to the vehicle.
- The customer shall ensure that all vehicle doors and windows are completely closed, and all interior and exterior lights are turned off.
- The customer shall remove all rubbish from the vehicle.
- The customer shall ensure that the vehicle’s fuel is not less than 20% or more upon completion of the trip.
- The customer shall ensure that the vehicle is photographed from all four sides and the photos are attached to the application
7.2 Maximum Duration of Use
- Yaldi has the right to freeze the customer’s account and stop the vehicle if the trip period exceeds the time stated in the application.
- The customer will bear the fees and/or fines as indicated in the fee schedule, until the vehicle is returned to the business area and the trip is completed.
- Yaldi reserves the right to recover the vehicle from its current location, to the extent permitted by law, if payment is not made or is refused or otherwise not authorized
- The customer will bear all costs, including replacement of the key if it is not returned immediately.
7.3 Return to the Area
- The trip will not be terminated unless the Yaldi vehicle is within the business area, subject to the parking as stated in the Application.
- The permitted limits are usually specified in the Yaldi Application.
- Any additional information can be obtained via the Yaldi Mobile Application. If the Customer is unable to contact Customer Service, the Company will terminate the trip remotely and send the Customer a confirmation of this.
- Yaldi may request the Customer to move the Vehicle to another location permitted by the parking rules specified in this Agreement.
- In the event that the Customer fails to return the Vehicle, he shall be responsible for this and may be subject to the penalties stipulated in accordance with this Agreement.
- Fees, Payments and Invoices
8.1 For Fees
The fees for the use of the Yaldi vehicle and related services shall be specified as amended from time to time. The Customer agrees to pay all amounts when due. The fees for the use of the Yaldi vehicle are due at the start of the trip period. The fees are payable in full at the end of the trip by closing the Application.
8.2 Invoices
The Customer will receive a summary of the trip via email, and a copy of the invoice will be added to the Customer’s account upon completion of the trip. The Customer acknowledges receipt of notice of all charges upon issuance of the invoice.
The toll gate/Salik charges in addition to the Company’s specified charges, fees, fines and any other costs resulting from the Customer’s usage will be added separately, upon receipt by Yaldi from the relevant authorities, and upon reporting. Additional administrative fees shall be charged based on the toll gate charges and fines in accordance with the fee structure.
8.3 Payments
Payments shall be made by Visa or MasterCard, or any other method that Yaldi may authorize in its sole discretion from time to time. The Customer authorizes Yaldi and its employees, agents or any assignees, to collect charges from the Customer using any payment information provided by the Customer to the Company’s designated payment partner. The Customer’s account shall have sufficient funds to cover all charges incurred by the Customer during the trip. The Customer shall be responsible for any charges associated with the credit card or any charges incurred by the Customer during the trip. The Customer authorizes Yaldi to reserve the balance through his payment card within 24 hours from the date of the start of the trip. The Company may suspend or terminate the Customer’s use of the Vehicle in the event that his payment card is declined (either due to a pre-authorization or due to outstanding fees). Yaldi may suspend or terminate the Customer’s use of its Vehicles. Prepaid gift cards are not accepted as a method of payment.
8.4 Billing History
The Customer has the right to check the trip period history, invoices and payment history via the Customer page in the Mobile Application.
8.5 Refunds or Appeals
Any request for a refund, adjustment of fees, fines, penalties, invoices or appeals shall be submitted to Yaldi within 7 days from the date of issuance of the invoice, provided that such request is in writing via email.
Refunds and appeals shall be subject to review and approval at the Company’s discretion and authority. The Customer acknowledges and agrees that objections or appeals will not be considered after the specified period for submission.
The Customer shall not be entitled to refund or reverse any bank payment transaction through the credit card company or the bank at any time, if the company does not agree to that. Any fees resulting from this procedure shall be claimed by Yaldi Company.
Yaldi Credits received in its account wallet may be assigned for usage fees only, and may not be deducted for traffic fees, fines, penalties or other fees.
Yaldi Credits are not refundable or exchangeable for cash.
Yaldi Credits may have an expiration date associated with them.
Yaldi Credits may not be transferred to any other account.
8.6 Current Payment Information
The Customer is fully responsible for providing Yaldi with all information related to the credit card and always updating it if necessary. Failure to do so may result in the Company terminating this Agreement temporarily or permanently, and canceling the Customer’s account in Yaldi.
8.7 Collection
Yaldi Company has the right to authorize a third party to collect the amounts due to the Company. The Customer shall be responsible for any collection or similar fees associated with such collection activities.
- Accidents, Damages and Traffic Violations
9.1 Uninsured Damages
The customer is solely responsible for all uninsured damages to the Yaldi vehicle during the trip, and is responsible for the full costs of any uninsured damages or injuries to third parties or their property, including:
- The customer bears the repair costs (estimated or actual to the Yaldi vehicle and third party property).
- The customer bears the damages to third parties.
- The customer bears the cost associated with the recovery or transportation of any Yaldi vehicle.
- The customer bears the loss of any Yaldi vehicle or property belonging to a third party.
- The customer bears compensation for damages during the vehicle repair period.
- In the event that the customer commits violations (black points), he is obligated to pay an amount of 500 dirhams for each point
- In the event that the vehicle is seized due to the customer committing violations, he is obligated to pay the car rental in addition to 200 dirhams compensation for each day of seizure.
9.2 Damage Charges
The amounts set forth in the Yaldi Schedule are the Customer’s liability for insured damages, provided that Customer has complied with this Agreement and the Terms of Use. Customers are liable for the full amount of such damages, actual, estimated or anticipated costs, whether or not an actual claim has been made. Yaldi reserves the right to charge damages at its sole discretion.
9.3 Failure to Benefit from Insurance Cover
The Customer shall be liable for the full cost of any such loss or damage if any loss or damage occurs during the trip due to the Customer’s actions or conduct.
9.4 Presumption
If damage to a Yaldi vehicle is reported or otherwise discovered by the Company, it is likely that the last person (i.e. other Customers) to use the Yaldi vehicle caused it and shall be liable to the Company for the damage caused in the absence of evidence. The Company shall be entitled to determine such liability at its sole discretion.
9.5 Loss of Property
- The Customer shall be solely responsible for the loss of any property belonging to the Yaldi vehicle, including the vehicle key or documents belonging to the Company.
- In the event that any property belonging to the Company is lost or is not in the vehicle at the end of the trip, the Customer shall pay the full amount for such property, as determined by the Company and subject to the damages incurred.
- Yaldi shall not be liable for the loss of any personal property or items belonging to the Customer.
9.6 Reporting Damage
- The Customer shall report to the Company any accidents, defects or damages to the Vehicle resulting from accidents, in the manner specified in this Agreement
- The Customer shall upload photos of the damages before and after the trip either through the mobile application or live chat on the website, or via email only, in addition to submitting a police report. Failure to do so may result in the Customer incurring additional fees.
9.7 Police Report
- The Customer shall remain at the location until the police allow him to leave if the police arrive at the scene of the accident.
- The Customer shall report the accident to the nearest police station. The Customer shall fill out an accident form in the event of a collision, accident, injury or any other accident, and submit a copy to Yaldi within 5 business days from the date of the accident, and ensure the accuracy of the details contained in the report.
- The Customer is responsible for ensuring the accuracy of the report and submitting it to Yaldi for use in any other context
- The Customer is responsible for partial or total damage and any other additional costs resulting from not submitting a police report if the report is not submitted within the specified period.
9.8 Entitlement to Compensation
Yaldi shall be entitled to any and all compensation or monies paid in respect of damage to Yaldi’s vehicle. The Customer agrees, in the event that the Customer receives any such monies, to hold them in trust on behalf of the Company and agrees to pay them immediately to Yaldi. Loss of eligibility or use of the vehicle in contravention of this Agreement may automatically exclude the Customer from the insurance coverage provided by the Insurance Company. The Customer shall be responsible for compensation for the full damage and any additional costs resulting from such damage.
9.9 Coverage
The Company provides comprehensive insurance coverage for all its vehicles, which includes the entire vehicle, in addition to basic coverage for the driver and passenger.
9.10 Customer’s Deductible/Excess Obligations
- The Customer shall be responsible for paying the deductible or excess fees in accordance with the fee schedule specified on the Yaldi website in the event of any claim relating to the Customer under the Company’s insurance policy.
- The Customer shall pay this amount in the event of any damages, accidents or losses in the absence of a police report, or if the police issue a white (unknown) or red (defective) accident report.
- The Customer shall be obligated to pay any fines and fees directly to the Company and may submit appeals after paying such fines or fees.
9.11 Damages and Customer Liability
- The Customer shall be responsible for theft, damage or loss of any of Yaldi’s property occurring during the trip period.
- The Customer shall be responsible for the full amount of such claim, including the cost of replacing or repairing any vehicle involved in all cases where Yaldi’s insurance policy does not cover a particular claim, or the value of such claim exceeds the coverage provided by the insurance policy.
- The Customer shall be responsible for all claims of any kind made by third parties. Yaldi will not share invoices, internal receipts or proof of payments related to fleet operations with the Customer under any circumstances.
9.12 Maintenance and Repair
The Customer shall ensure that no maintenance or repair is carried out on the Vehicle. If the vehicle is not operating as required or appears to be in need of maintenance or repair, the Customer shall immediately notify the Company so that appropriate action can be taken.
- Responsibilities
10.1 Limitation of the Company’s Liability
The Customer acknowledges that, to the extent permitted by law, Yaldi will not be liable to the Customer or third parties for any damages or losses arising from or in connection with:
- In the event of the failure, interruption or disruption of any service or the unavailability of the Application or Services, regardless of whether provided by Yaldi or a third party
- In the event of the quality, accuracy, timeliness, speed and performance of any car rental company or the service or the Application (including without limitation any breach by the car rental company of any obligation)
- In the event of errors or inaccuracies in any content or information available on or through the Application
- Any unauthorized access to, or use of, the Yaldi Application or any personal information stored therein, or any interruption or cessation of transmission to or from the Yaldi Application, or any errors, viruses, or the like, which may be transmitted to or through the Application by any third party; Or any failure or delay in executing any transactions through the Application or Services
- In the event of any dispute, conflict or disagreement between other members or the public in relation to any Services.
- In the event of loss of profits or loss of business reputation (whether directly or indirectly) or any injury, accident, physical damage, property damage, health problems or otherwise that may occur to the Customer.
10.2 Indemnification
The Customer shall be responsible for indemnifying and holding Yaldi (including its subsidiaries, affiliates, successors, assigns and each of their respective officers, directors, agents and employees, jointly and severally) harmless from and against all losses, claims, liabilities, damages, suits, fines, penalties, judgments and expenses (including, without limitation, legal expenses on the attorney and his client), incurred or brought against any or all of them, including by third parties, due to any act or omission by Yaldi or its officers, directors, agents, employees or contractors or the Customer’s use of Yaldi vehicles.
- Terms of Use
11.1 Customer Obligations:
The Customer shall:
- Use Yaldi vehicles with care and attention, adhere to applicable speeds, such as local speed limits and follow the traffic rules and regulations in the UAE.
- Report any collisions or damage to the vehicle resulting from the accident to the Traffic Police immediately, and also report this to Yaldi and the Customer Service Center, at the Customer’s own expense.
- Send a copy of the traffic report or other documents related to the accident to them upon Yaldi’s request.
- Take all precautionary measures to prevent the vehicle from being stolen (windows shall be closed and the central locking system activated).
- Ensure that the vehicle is used only when it is roadworthy.
- Drive in a manner that aims to avoid excessive fuel consumption in the vehicle.
- Fuel the vehicle only at ENOC/EPPCO fuel stations.
- Bear the cost of fueling the vehicle if it is outside the city of operation.
- Not pay any amounts for fuel or anything else on behalf of Yaldi, unless confirmed in writing or verbally by Yaldi. The Customer shall also retain a copy of the receipt and send it to Yaldi to claim its value within 30 days, and the principal payment shall be through Yaldi accounts.
- To comply with all applicable laws, including traffic, health and safety laws, criminal and civil laws.
- To park the Vehicle in accordance with the parking rules, as stated on the Website, in free and uncovered parking spaces (i.e. without a roof, wall, ceiling, tent or other covering over the Vehicle) in the designated work area, or in any spaces permitted by Yaldi in its sole discretion.
- To notify Yaldi of any tickets or warnings related to traffic or driving violations, received while using the Vehicle or during the trip, including parking tickets. Regardless of whether Yaldi is notified of any tickets or warnings related to traffic or driving violations, the Customer agrees to bear all costs, fines and administrative fees resulting therefrom.
- To keep passwords or other codes strictly confidential, and not to disclose them to third parties. Passwords or other codes should not be recorded in writing or electronically.
- To pay any costs or damages arising from unauthorized use by a third party. If the Customer has reason to believe that a third party has obtained a password or other similar code, the Customer shall change the compromised password or code or notify Yaldi immediately.
- To provide and maintain Yaldi’s email, mobile phone, home address, mailing address and other account information.
- To provide Yaldi with the precise location of the vehicle used by the Customer.
- To allow Yaldi or any third party to inspect any Company vehicle upon its request.
11.2 Prohibited Behavior
The Customer shall not:
- Use the Vehicle if under the influence of alcohol, drugs or medications that may adversely affect his/her ability to drive. It is strictly forbidden to drink alcohol while driving (this includes alcohol and drugs, whether prohibited by law, prescribed or otherwise). Yaldi does not permit this at all.
- Allow third parties to drive the Vehicle (including individuals who are themselves customers, but who have not embarked on the current trip).
- Give or lend the Vehicle to a third person or use the Vehicle for the purpose of delivering third parties.
- Drive the Vehicle off-road or in motor racing of any kind.
- Engage in any distracting activity prohibited by applicable laws or regulations or use any electronic device while driving the Vehicle.
- Use the Vehicle for specific tests, driving education or for transporting individuals as part of a business.
- Abuse Yaldi employees, whether verbally, physically or racially, through any means of communication, which may lead to termination of the Contract and the Contractual Relationship.
- To use the vehicle to transport flammable, toxic or dangerous goods, except for goods used for domestic use.
- To use the vehicle to transport objects that, due to their size, shape or weight, could adversely affect the safety of the vehicle or damage the interior of the vehicle.
- To use the vehicle as an instrument for committing a crime or any other unlawful act.
- To smoke (including electronic cigarettes or the like), eat or drink inside the vehicle, use tobacco products in the vehicle, or allow companions to smoke or allow them to use tobacco products inside the vehicle.
- Not to carry any animal inside the vehicle unless such animal is identified as a guide animal for a disabled person and shall be contained safely and appropriately.
- To leave any type of garbage in the vehicle.
- To remove objects attached to the vehicle or that form part of the vehicle’s equipment.
- The customer is prohibited from driving the rented vehicle while under the influence of drugs or any intoxicating substances.
- To transport persons or goods for a fee is strictly prohibited under the terms of this agreement.
- Under no circumstances may the rented vehicle be used to lift or tow another vehicle.
- The customer shall refrain from using the vehicle for towing purposes or possessing or transporting any prohibited materials inside the vehicle.
- The sub-lease of the vehicle to a third party shall be prohibited.
- The vehicle shall not be used by individuals who do not have a valid driving license or those who have not been officially added as licensed drivers in the contract.
Any violation of these terms shall result in a fine of not less than AED 5,000, and in the event that higher penalties are imposed by the authorities or the vehicle is confiscated, the customer shall bear full responsibility for all fees or compensations.
- Governing Law
This agreement shall be governed by, construed and enforced in accordance with the laws of the United Arab Emirates, and the rights of the parties shall be subject to the laws of the United Arab Emirates.
Each party irrevocably submits to the jurisdiction of the courts of the Emirate of Dubai under this agreement.
- Acknowledgment
The customer acknowledges that he has read and understood the terms of use.
The customer agrees to abide by the terms of use as updated from time to time.
Yaldi has the right to change the Terms of Use at any time, by posting the Terms of Use / Alternative Terms and Conditions in the Terms and Conditions section on the Yaldi website or through the application.
It is the customer’s responsibility to review the Terms of Use periodically and continuously.
Privacy Policy
Data Retention Policy, Managing Your Information
Please note that we retain user data as long as you continue to use the application, and for a reasonable period thereafter. We retain information collected automatically for 24 months, after which we may store it.
If you would like us to deactivate the user data you have provided through the application, please contact us on customer service and we will respond within a reasonable time.
Please note that some or all of the data provided by the user may be required for the application to function properly.
Termination of these terms does not mean relieving customers from their obligation to pay any amounts due to us, or due to us, and termination does not prejudice all previous rights and obligations of you and us.
All indemnification and liability provisions in the Membership Terms will survive termination.
Please note that we do not use the App to solicit data from or market to children under 13.
If a parent or guardian becomes aware that their child has provided us with information without their consent, they should contact us at Customer Service and we will delete that information from our files within a reasonable time.
Data Protection
We are concerned about protecting the confidentiality of your information. We provide physical, electronic and procedural safeguards to protect the information we process and maintain. For example, we limit the number of authorized employees and contractors who need to know your personal information.
Changes
This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting them on our website.
We advise you to review the Privacy Policy regularly to check for any amendments, as continued use will be deemed acceptance of all changes.
Your Consent
Your use of the Application grants us the right to access your information as set out in this Privacy Policy and as amended by us. This means using cookies on a computer/handheld device or using the information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which take place in the United Arab Emirates.

Fees and fines for Yaldi services
- YALDI HOURLY CAR RENTAL L.L.C & fees are as follows:-
- An amount of 0.99 dirham is imposed per minute addition to 5% value added tax
- The company imposes a trip start fee starting from 6 dirhams per trip.
- Includes administrative fees of 300 dirhams for each Traffic Fine.
- Specified Salik fees in addition to 1.5 dirhams as an administrative fee for each passage through Salik gates.
- Fines imposed upon violation of the terms and conditions.
